Article 1. Purpose These Terms of Service (“Agreement”) set forth the terms, conditions, and operational policies governing the use of services provided by AL HAWAII CONSULTING INC (hereinafter referred to as the "Website").
Article 2. Definitions The following terms are defined for the purposes of this Agreement:
Member: A user who agrees to these Terms and registers by providing personal information, thereby entering into a service agreement with the Website.
Service Agreement: A contractual relationship established between the Website and the Member concerning the use of services.
User ID: A unique combination of letters and numbers assigned to each Member for identification and service usage.
Password: A combination of characters created by the Member to verify identity and protect their account.
Operator: The individual or entity managing and operating the Website.
Termination: The act of a Member canceling the Service Agreement.
Article 3. Supplementary Provisions The Operator may establish and announce separate operational policies as necessary. In the event of any conflict between this Agreement and such policies, the operational policies shall prevail.
Article 4. Formation of Service Agreement
The Service Agreement is formed when an individual who wishes to register as a Member agrees to these Terms and submits an application, which is then approved by the Operator.
By checking the "Agree" box during the registration process, the applicant is deemed to have expressed consent to this Agreement.
Article 5. Application for Service Use
Individuals applying for membership must provide all information requested by the Website (e.g., User ID, password, nickname).
Users who provide false information or impersonate others will not have any rights under this Agreement and may be subject to penalties under applicable law.
Article 6. Privacy Policy The Website and Operator do not store Members’ passwords. Password-related matters follow the Website's privacy policy. The Operator will strive to protect Members' personal information as required by applicable laws.
The handling of personal data shall be governed by relevant laws and the privacy policy of the Website. The Operator bears no responsibility for information disclosed due to the Member's own fault.
If a Member posts content that violates public order, decency, or national security, and such content is subject to requests from relevant authorities, the Operator may access and submit the Member's data accordingly.
Article 7. Obligations of the Operator
The Operator shall handle valid complaints or feedback from Members promptly. If processing is delayed, the Member shall be notified via message or email.
The Operator shall ensure continuous and stable operation of the Website. In case of system failure, the Operator shall act to repair or restore functionality as quickly as possible, except in cases of force majeure.
Article 8. Obligations of the Member
Members must comply with these Terms, operational policies, notices, and all applicable laws. Members shall not engage in any activity that interferes with the operation or reputation of the Website.
Members may not transfer, lease, or pledge their service rights to third parties without the Website's explicit consent.
Members must manage their IDs and passwords carefully and must not allow others to use them without authorization.
Members must not infringe upon the intellectual property rights of the Operator, Website, or third parties.
Article 9. Service Hours
The Website is available 24/7, except during scheduled maintenance or in the event of technical issues. Advance notice will be posted for any planned downtime.
The Website may be suspended without prior notice under the following circumstances:
Emergency maintenance or system errors
Natural disasters, national emergencies, or other force majeure
Disruption from telecom providers
Service overload or technical limitations
When possible, advance notice of service suspensions will be given. If notice is not feasible due to circumstances beyond the Operator’s control, it will be provided afterward.
Article 10. Termination of Service
Members wishing to terminate their membership must submit a cancellation request online. Separate cancellation procedures may apply to other services.
Upon termination, the Member’s profile and related data will be deleted and no longer accessible to the Operator.
Article 11. Restrictions on Use Members are prohibited from engaging in the following activities. Violation may result in suspension or termination of service:
Providing false or misleading information
Disrupting or impersonating others on the Website
Impersonating staff or affiliates of the Website
Infringing on the rights or disrupting the operations of the Website or third parties
Using another Member’s ID without authorization
Collecting or distributing personal data of other users without consent
Engaging in criminal or unlawful conduct
Violating applicable laws and regulations
Article 12. Management of User Content
The Operator reserves the right to monitor and manage content posted on the Website. Inappropriate content may be removed and the Member notified.
If required by law or government authority, the Operator may remove or relocate content without the Member’s prior consent.
Content is considered inappropriate if it:
Defames or harasses others
Violates public decency or social order
Encourages piracy or illegal activity
Contains unsolicited advertising
Infringes on intellectual property rights
Violates laws or regulations
If the Website receives a takedown request due to defamation or rights infringement, content may be removed temporarily pending resolution.
Article 13. Preservation of Content If the Website is to be shut down, advance notice will be provided and efforts will be made to allow Members to preserve their content.
Article 14. Copyright
Copyright of content posted by Members remains with the original author. The Website may not use such content for commercial purposes without consent, though it retains the right to display it within the service.
Members may not reproduce or sell content obtained through the Website for commercial gain.
The Operator reserves the right to delete or reject content that violates Article 12.
Article 15. Liability for Damages
Members are primarily responsible for any legal liabilities arising from their use of the Website.
The Website shall not be liable for damages resulting from force majeure events or Member misconduct.
Article 16. Disclaimer
The Operator is not liable for Members' expected outcomes or losses from their use of the Website.
The Operator is not responsible for issues arising from third-party telecom service providers.
The Operator is not responsible for user-submitted content.
The Operator bears no liability for disruptions caused by Member negligence.
The Operator is not responsible for disputes between Members or between Members and third parties.
The Operator does not guarantee the accuracy or reliability of content accessed through the Website.
The Operator is not liable for any commercial transactions between Members facilitated through the Website.
The Operator is not liable for external or internal disputes unless due to Operator fault.
The Operator is not liable for damages due to unavoidable system issues, cyberattacks, or undetectable viruses.
Article 17. Refund Policy Requests for refunds must be submitted via the Customer Service Center.
Cancellations are subject to the policies of the respective service provider.
Cancellation fees may apply.
Partial refunds follow the policy of each component service.
Refunds may take up to 30 days, subject to credit card processing times.
Services already rendered are non-refundable.
Supplementary Provision These Terms of Service are effective as of April 23, 2023.
